Can I cancel my Villa del Palmar Timeshare Contract?

Whether or not you can cancel your Villa del Palmar timeshare contract will depend on various elements and your individual situation, but below you will find some basic guidance.

Firstly, your chance to cancel your Villa del Palmar timeshare contract and gain a refund (in the case that you have paid a deposit) will depend a lot on the time frame in which you decide to cancel. All timeshare contracts are given what is called a “cooling off” period, which can be anywhere between 7 and 14 days. The Villa Group properties, of which Villa del Palmar resorts form part have a 7 day cancellation period. Therefore, you will need to cancel your timeshare in writing within this time.

If you want to cancel your Villa del Palmar timeshare contract after the cooling off period you will need to have legal grounds for terminating your agreement, such as gross misrepresentation or evidence of fraud. In those extreme cases, you would need to get a lawyer to act on your behalf to collect evidence and prepare a case. As The Villa Group pride themselves on being a highly reputable timeshare company, there are few occasions where valid reason for a termination of contract have been presented.

However, if you do feel that you have grounds for canceling your Villa del Palmar timeshare contract, make contact with The Villa Group directly first to see if there is any way they can help you with your dissatisfaction. It is also important to notify them of any misrepresentation so that they may use the complaint for quality assurance and correct management of their sales team.

Every timeshare contract must mention a rescission period that goes normally from 5 to 10 days, depending on the regulations established on the place where you bought the property. In Mexico, that rescission period is on a 5 day record, then you have 5 days to inform the company that you want to cancel the contract. Nevertheless, in most cases people look to cancel the timeshare when the cooling-off period has already past. In those cases it is advisable to contact an expert. There are various timeshare cancellation companies who claim to help people who are victims of a timeshare scam, but still many people don’t trust these companies, which is completely understandable being that the timeshare industry is full of scammers, that is why is always important to research on a company before making any kind of deal with it. You also have to remember that to cancel a timeshare you don’t have to pay an upfront fee.

Make sure you avoid cancellation scams too. There are many companies that will claim they can help you to cancel your timeshare when they have no lawful grounds to do so.

I agree! We got scammed by a well-known cancellation company who said they could cancel our timeshare. We ended up paying quite a lot of money and in the end nothing could be done to cancel the timeshare anyway. The best advice is to contact the timeshare company directly.

Timeshare cancellations are basically all scams. According to my attorney, you can’t cancel after the cooling off time anyway, even if they claim to be able to do so.
